1. Introduction

These Terms and Conditions ("Terms") govern the use of services offered by Skillfix International Limited ("Skillfix," "we," "us," or "our"), a limited company registered in Kenya, through our website www.skillfix.org (the "Site") and any related communication channels (phone, email, WhatsApp, or in-person engagements).

By requesting, purchasing, or using any service from Skillfix, you ("the Client," "you") agree to be bound by these Terms in full. If you do not agree with any part of these Terms, please do not proceed with our services.

This document is a standalone Terms and Conditions page, separate from our Privacy Policy and Cookie Policy, which are published independently on the Site.


2. Our Services

Skillfix International provides professional development consulting services, including but not limited to:

  • CV / Resume writing and revamping
  • Cover letter writing
  • LinkedIn profile optimization
  • Interview coaching and preparation
  • Career coaching and job search strategy
  • Corporate training and workshops
  • Skillfix Platinum Membership (Skillfix Club)
  • Other professional development and career advisory services as listed on the Site from time to time

Service inclusions, deliverables, and turnaround times may be updated periodically and will be confirmed with the Client at the point of booking.

4. Payment Terms

4.1 Payment Method

All payments must be made exclusively via M-Pesa Paybill:

No other payment channel (including direct M-Pesa transfer to a personal phone number, bank transfer, cash, or any third-party platform) is recognized by Skillfix. Any payment made to a number, account, or channel other than the official Paybill above shall be deemed void, and Skillfix accepts no liability for funds sent through unofficial channels. Clients are strongly advised to confirm payment details directly with Skillfix via +254 700 231 231 or support@skillfix.org before making payment, especially where communication has occurred through unofficial or unverified contacts (e.g., personal social media accounts, unlisted phone numbers).

4.2 Payment Before Service

Full payment is required before any work begins. No draft, consultation, or deliverable will be initiated, and no session will be scheduled, until payment has been made and confirmed by Skillfix.

4.3 Fixed Rates

All service rates are fixed as published on the Site or as quoted in writing at the time of booking, and are payable in full in Kenya Shillings (KES) unless otherwise agreed in writing.

4.4 Proof of Payment

Clients should retain their M-Pesa confirmation message as proof of payment. Skillfix may request this confirmation before commencing work.


5. Revisions and Amendments (CV & Document Services)

5.1 Initial Revisions

Following delivery of the first draft, revisions are unlimited until the Client is fully satisfied, provided all revision requests are made within 3 days (72 hours) of the initial delivery date.

5.2 Later Revisions

After the initial 3-day window, further edits to the same document are chargeable as follows:

5.3 Rationale

This tiered structure reflects that a document is more likely to need substantive updates (new roles, achievements, or career direction) the longer it has been since the original engagement, effectively constituting new work rather than a minor revision.

5.4 What Counts as a Revision

A revision includes corrections, formatting adjustments, and content refinements to the existing document based on the original brief. Requests that materially change the scope of work (e.g., converting a CV into a full portfolio, adding entirely new sections not part of the original brief, or requesting an additional document type) may be treated as a new service and quoted separately.


6. Rush / Expedited Services

Where a Client requires a service to be completed on an accelerated timeline outside our standard delivery window, a rush fee of 30% of the total service fee applies, in addition to the standard rate. Rush delivery is subject to Skillfix's availability and capacity at the time of the request and is not guaranteed until confirmed in writing.


7. Corporate Training Services

For corporate training and workshop engagements:

  • A non-refundable deposit of 50% of the total fee is required to confirm and reserve the training date.
  • The remaining 50% balance is due on or before the first day of training.
  • Training content, duration, and logistics will be confirmed in a separate written agreement/proposal for each engagement, which forms part of these Terms for that specific booking.

8. Cancellations

If a Client cancels a confirmed booking before work has commenced, Skillfix will refund the amount paid less a 10% cancellation/administrative fee. Once work has commenced (i.e., a first draft or deliverable has been started), the engagement is treated as in progress and is subject to the Refund Policy in Section 9.

Cancellations must be communicated in writing via email (support@skillfix.org) or phone (+254 700 231 231).


9. Refund Policy

All services are non-refundable once payment has been made and work has commenced. Because our services involve time, expertise, and effort committed immediately upon confirmation of payment, Skillfix does not offer refunds for completed or in-progress work, change of mind, or client-side delays in providing information needed to complete the engagement.

Clients are encouraged to review service descriptions, ask questions, and confirm requirements with our team before making payment.


10. Client Responsibilities

To enable Skillfix to deliver quality work within agreed timelines, the Client agrees to:

  • Provide accurate, complete, and truthful information (work history, qualifications, achievements, etc.) relevant to the service requested.
  • Respond to requests for information or feedback in a timely manner.
  • Review draft deliverables promptly and communicate revision requests within the applicable window (see Section 5).

Skillfix is not liable for outcomes (e.g., job offers, interview results, admission decisions) affected by inaccurate, incomplete, or delayed information provided by the Client.


11. Intellectual Property & Ownership of Deliverables

Upon full payment and delivery, all rights to the final document(s) (e.g., CV, cover letter, editable Word file) transfer fully to the Client, with no restrictions on how the Client may use, edit, share, or distribute the document going forward. Skillfix does not retain licensing rights, usage restrictions, or claims over completed and delivered client documents.

Skillfix retains the right to use anonymized excerpts, general project descriptions, or client testimonials (with the Client's separate express consent) for marketing and portfolio purposes. No personally identifying details will be used without the Client's consent.


12. Confidentiality

Skillfix treats all Client information (personal, professional, and financial) as confidential and will not share it with third parties except: (a) with the Client's consent, (b) as required to deliver the contracted service, or (c) as required by law. See our separate Privacy Policy for full details on data handling.


13. Limitation of Liability

To the maximum extent permitted by law, Skillfix's total liability to the Client for any claim arising from or related to our services — whether in contract, tort, or otherwise — shall be limited to the total amount actually paid by the Client for the specific service giving rise to the claim.

Skillfix is not liable for:

  • Indirect, incidental, or consequential losses (e.g., loss of employment opportunity, loss of income);
  • Outcomes of job applications, interviews, promotions, or admissions, which depend on factors outside our control;
  • Delays caused by incomplete or late information from the Client, third-party platforms, or events beyond our reasonable control (see Section 15).

14. Eligibility

Our services are available only to individuals aged 18 years and above, or to organizations engaging Skillfix for corporate training on behalf of their employees. By engaging Skillfix, the Client confirms they meet this age requirement or are duly authorized to act on behalf of an eligible organization.


15. Force Majeure

Skillfix shall not be held liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to natural disasters, internet or power outages, government action, or other unforeseeable events. Affected timelines will be communicated and adjusted accordingly.


16. Amendments to These Terms

Skillfix reserves the right to update or modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services after changes are posted constitutes acceptance of the revised Terms. Material changes affecting an active, already-paid engagement will not be applied retroactively to that engagement.


17. Dispute Resolution

In the event of a dispute arising from these Terms or any service engagement, the parties agree to the following escalation process:

  1. Negotiation — The parties shall first attempt to resolve the dispute through direct, good-faith negotiation between Skillfix and the Client.
  2. Mediation — If negotiation fails to resolve the dispute within a reasonable period, the parties agree to attempt resolution through mediation by a mutually agreed mediator.
  3. Courts of Kenya — If mediation is unsuccessful, the dispute shall be referred to and finally resolved by the courts of the Republic of Kenya, which shall have exclusive jurisdiction.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya.


19. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.


20. Entire Agreement

These Terms, together with any specific written proposal, quotation, or agreement issued for a particular engagement, constitute the entire agreement between the Client and Skillfix regarding the services provided, superseding any prior oral or written understandings.

1. Introduction

Skillfix International Limited ("Skillfix," "we," "us," "our") is committed to protecting the privacy and personal data of our clients and website visitors. This Privacy Policy explains how we collect, use, store, share, and protect personal information when you visit www.skillfix.org (the "Site") or engage any of our services.

This Policy is issued in accordance with the Kenya Data Protection Act, 2019 and its associated regulations. Skillfix International Limited is registered as a Data Controller with the Office of the Data Protection Commissioner (ODPC), Kenya.

By using our Site or engaging our services, you consent to the collection and use of your information as described in this Policy. This Policy is separate from our Terms and Conditions and Cookie Policy, which are published independently on the Site.


2. Information We Collect

We collect information necessary to deliver our professional development services. This may include:

2.1 Information You Provide Directly

  • Full name, phone number, and email address
  • Employment history, education, skills, achievements, and other career-related content (for CV, cover letter, and LinkedIn services)
  • Payment confirmation details (e.g., M-Pesa transaction reference) — note: we do not collect or store card numbers or M-Pesa PINs
  • Any additional personal information you choose to include in documents you share with us (e.g., national ID or passport number, if you include this in your CV content — we do not separately request this)
  • Feedback, testimonials, or correspondence you send us

2.2 Information Collected Automatically

  • Basic technical information necessary for the Site to function (e.g., browser type, device type)
  • We currently do not use analytics or advertising tracking tools (such as Google Analytics or ad pixels) on the Site. If this changes in future, this Policy will be updated accordingly, and a separate Cookie Policy will govern any such tools.

3. How We Use Your Information

We use the information we collect to:

  • Deliver the specific service you have requested (e.g., write or revise your CV, prepare interview coaching materials, run corporate training)
  • Communicate with you about your booking, drafts, revisions, and delivery
  • Process and confirm payments made via our official Paybill channel
  • Send you service-related updates (e.g., delivery notifications, revision reminders)
  • Send marketing communications — newsletters, tips, promotions, and updates about Skillfix services — where you have not opted out (see Section 7)
  • Improve our services and internal processes
  • Comply with legal, tax, or regulatory obligations

4. Legal Basis for Processing

We process your personal data on the following legal bases under the Data Protection Act, 2019:

  • Performance of a contract — to deliver the service you have paid for
  • Consent — for marketing communications and optional testimonial use
  • Legal obligation — for tax, financial, and regulatory record-keeping
  • Legitimate interest — for service improvement and business administration, balanced against your rights

5. How We Store Your Information

Client information (documents, contact details, correspondence) is currently stored using a combination of email systems and local files maintained by Skillfix. We take reasonable administrative and technical measures to protect this information from unauthorized access, loss, or misuse, including restricting access to authorized personnel only.

As Skillfix grows, our storage systems may evolve (e.g., to a dedicated client management system); this Policy will be updated to reflect any such changes.


6. Sharing of Information

We do not sell your personal information to third parties. We may share limited information with:

  • Safaricom / M-Pesa payment infrastructure — solely to process and confirm payments made via Paybill 4017787
  • Email and communication service providers — used to send and receive correspondence and deliverables
  • Regulatory or government authorities — where required by law, court order, or a lawful request from the ODPC or other competent authority
  • Corporate clients (for corporate training engagements) — limited to information necessary for coordinating the training (e.g., participant names/attendance), where applicable

We do not currently transfer personal data outside Kenya. If this changes, we will ensure such transfers comply with the cross-border data transfer requirements of the Data Protection Act, 2019.


7. Marketing Communications

We may send you newsletters, tips, and promotional updates via email, SMS, or WhatsApp using the contact details you provide. You may opt out of marketing communications at any time by:

  • Clicking "unsubscribe" on any marketing email, or
  • Contacting us directly at support@skillfix.org or +254 700 231 231 to request removal from marketing lists

Opting out of marketing communications does not affect service-related communications necessary to deliver an active engagement.


8. Data Retention

We retain client personal data for as long as necessary to deliver the service and maintain reasonable business, financial, and legal records. Where a client has had no further engagement or contact with Skillfix, their personal data will generally be deleted or anonymized after 24 months of inactivity, except where we are required to retain certain records for longer to comply with legal, tax, or regulatory obligations.

Clients may request earlier deletion of their data at any time, subject to Section 9 below.


9. Your Rights

Under the Data Protection Act, 2019, you have the right to:

  • Access the personal data we hold about you
  • Request correction of inaccurate or incomplete data
  • Request deletion of your data, subject to our legal/record-keeping obligations
  • Object to or restrict certain processing (e.g., marketing communications)
  • Request data portability, where technically feasible
  • Withdraw consent at any time, where processing is based on consent (this does not affect processing carried out before withdrawal)
  • Lodge a complaint with the Office of the Data Protection Commissioner (ODPC) Kenya if you believe your data protection rights have been violated

10. Data Security

We implement reasonable technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction, including restricting internal access to client information on a need-to-know basis. However, no method of electronic storage or transmission is 100% secure, and we cannot guarantee absolute security.

In the event of a data breach that poses a risk to your rights and freedoms, we will notify affected clients and the ODPC as required under applicable law.


11. Children's Privacy

Our services are intended for individuals aged 18 years and above. We do not knowingly collect personal data from minors. If we become aware that we have inadvertently collected data from a minor without appropriate consent, we will take steps to delete it.


12. Testimonials and Portfolio Use

Where a client provides positive feedback or agrees to be featured as a testimonial or case study, we will only use such content — and any accompanying name, photo, or identifying detail — with the client's separate, explicit consent. Clients may withdraw this consent at any time by contacting us.


13. Cookies

The Site currently does not use analytics, advertising, or tracking cookies. Any cookies used are limited to those strictly necessary for basic site functionality. Should Skillfix introduce analytics or marketing cookies in future, we will update this Policy and, where required, seek your consent via a cookie notice.


14. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. The updated version will be posted on this page with a revised "Last Updated" date. We encourage you to review this Policy periodically.
